Don't worry Flipper, I've also had problems with DW saving documents... Naffing around for half an hour wondering why nothing is changing on the page, then finding all you have to do is restart DW - Grrrr.

What she said. I made a local copy to test with, swapped the ampersand, and lo, it validated.
