You only posted a small quote from your diclaimer but I'm thinking that you might want to have that looked at by a lawyer. It should fully flesh out what is and is not permitted (and again, I haven't seen the whole thing so what you've got may go into more detail). Just in case this happens again you may want to have a more legally defined disclaimer to fall back on.

Another way to look at it, if they don't take it off and havent changed the names then it's more advertising for your bands site as people could search for their music and info. Try getting them off teh other site first, you could always report them to there web host as well.

Send them an email, but make it sound like it's from a lawyer and that if they don't remove the files within 48 hours, you'll be forced to take legal action. If they don't remove the files, contact their host and report the copyright issue, usually hosts shut down sites that are in violation to these terms. I beleive there are places where you can get premade legal letters, maybe you can do a search or someone else knows where you can get them.
