Google’s Webspam team is working with our Sitemaps team to alert some (but not all) site owners of penalties for their site. In my world (webmasters), this is both a Big Deal and a Good Thing, even though it’s still an experiment. Sign up for Sitemaps to try it out. Oh, and the Sitemaps team introduced a bunch more new and helpful features too. Check out the Sitemaps Blog for more info.

So would there be a bigger chance of getting caught if you use Google Sitemaps?

No, Googlebot will catch and penalize sites with no warning.

how come some sites are fine in google, and other sites still don't show up in google's serps (not even top 100) when they do well in yahoo and msn. there's no explanation in sitemaps for these sites not doing well.

It has nothing to do with Google's sitemaps. It has to do with G's algo's being different from other SE's. Google's sitemap only helps Google index sites better, especially sites with dynamic pages. But some sitemap users will soon be notified of penalties. This seems to be an advantage for site owners who use G's sitemaps over non-users.

if google first alerts web masters before imposing penalties, it is a good news.

what you are saying is absolutely fine. it will be better if google allert web masters to take some corrective steps before penalize a site.

I also welcome the change. but why should google have to know who owns what websites? are they trying to get even more data of ours? they are not WHOIS.

Google is not bound by any rules that webmasters may imagine. If they can improve their search results by identifying sites (and site owners) that try to cheat what is wrong with that?
