seeing as Napster has to be shut down as of midnight Friday...
In my eyes all the other programs were inferior as they lacked good amount of people due to napster dominating.
So who will everyone go to ?

I think Gnutella is good, but will never been as popular is Napster because it's open source and most people will probably get confused with all the different versions. I think some of the others, which I can't remember the names of, will be more popular. I think one is made by the creators of WinAMP...

Like the copying of CD's and mp3's will stop just because napster has been shut down
. Just because Florida slammed multibillion dollar lawsuit against the Big Tobacco doesn't mean anyone stops smoking (just as a comparison).

Napster wasn't told to shut down, they were told to that they were told to stop users from trading copyrighted songs. But they said the judge didnt provide them with a list so they didnt know what to stop and what to leave. 90% of the songs traded are copyrighted.

On Wednesday night, a U.S. District Court in San Francisco ruled in favor of a preliminary injunction to force the site to stop offering access to digital versions of songs whose copyrights are owned by the major labels.
The injunction takes effect midnight Pacific time Friday (0700 GMT Saturday) but the company has until noon Pacific time Thursday to file its appeal with the U.S. Court of Appeals, Ninth Circuit in San Francisco, which the company intends to do, a spokeswoman told Reuters. The court has until 9 a.m. Pacific time Friday to issue a ruling, she added.

according to Yahoo! news its just the copyrighted material, and also CNet said the same. But, as Napster says, ultimately the whole program will not function without all the songs.

I don't think that just because Napster is being shut down temporarily that it will be shut down for good, nor will the unauthorized trading of MP3's.
To answer the main question of the post, I think it'll be a program that is currently in the basic development stages somewhere around the world

I think this person made a very wise statement:
"The record companies should be careful about what they ask for," said Stephen Bradley, a research fellow for Gartner, a technology consulting firm.
``Their shortsighted desire to shut down Napster will make it nearly impossible for them to control the online trading of music. With Napster, there is a credible company with experienced management and a 20-million-user captive audience in one potentially manageable place. With Napster potentially shut down, the record companies have no one to negotiate with as distributed trading architectures like Gnutella have no management team, facilities or place of business.''

The Artists aren't going to see a dime more OR less than what they recieve now. It's the Record companies that are going to buy out on this.
Another interesting fact is that I plan on sending the RIAA the UPC's from every single CD in my collection [which is about five hundred CD's.]
Another thing, Scour Xchange has already been building up its legal team, and it gets a -lot- more money from its ads than Napster did, and so I think that the RIAA is going to have a tough time shutting them down.

Globalscape said it is restricting public access to its CuteMX file-sharing service pending a review of further developments surrounding the preliminary ruling in the Napster case. Like Napster, CuteMX allows individuals to find and retrieve files from each other's computers, routing requests through a central server.

oh well, there goes another one. also the more money you have the faster the RIAA will go after you. MP3.com had like hundreds of millions, didnt make a difference. The RIAA still won that case.

Yep, CuteMX, which in many ways is better than Napster, got a little nervous and has blocked access to the service while they see how the Napster case works out. Maybe they'll open up again now that Napster has a stay of execution until Mid-August. But Brian hit the nail on the head here. The RIAA has been cutting it's own throat on this issue from day one.
In Napster they had mp3 trading centralized into one major, potentially profitable business from which they could have taken a cut. By forcing Napster to close, all they're doing is forcing the mp3 traders to use a service that's impossible to monitor, enforce or make a dime from. What's even worse is that they're helping to advertise the very services that will prove to be their downfall. Before this lawsuit has put Napster on the front page of every newspaper in the country, Napster was more of a cult following, big among teens and college students, but virtually unknown everywhere else. The other players like Gnutella and Scour were too small and too unknown to be much of a threat to anyone. Now, thanks to the free publicity provided by the RIAA, Napster is a household name. That's the sort of thing that money just can't buy. Now, millions of people every day learn about mp3 piracy and how simple it is to do it. They learn not only about Napster, but about Gnutella, CuteMX, Scour Exchange, etc. They learn that when using the anonymous peer-to-peer clients like Gnutella that they're totally invisible and can't be caught. It's a free education on how to pirate music and it's provided by ABC, NBC, CBS, the BBC, the New York Times and the London Post and the Daily News and every major news source in the world and the RIAA is paying for the tuition. It's a little like the IRS taking out full-page ads to teach people how to effectively cheat on their taxes or Wal-Mart running a seminar on how simple it is to shoplift.

scour xchange is also being sued but not jus by the RIAA, there are a few other big companies in there, so I wouldn't get to attached to it.

And if Metallica were smart, or the RIAA, they would be working with Napster, not trying to put them down.

Hmm. You know, I saw an article that Courtney Love did on this whole issue, but I seem to have lost it. Anyways, it basically said this:
In the end, when all is said and done, the Artists themselves do not own any of their music, and they are indebited to the Record Companies. It's a nice ride, but it all ends in you getting screwed. The RIAA is a music pirate, not the users of Napster.
Oh.. I just noticed that I now surpass Ravi in posts! Mooahahahah! I am taking over the board! You all shall perish in a flame of eternal hangups!

While I'm off topic, I'd like to mention that Mike (TheGraphicsExperiance) is about 1600 posts behind me...
