I'm annoyed -- phonetic spellings?! Someone honestly would do anything other than chuckle at the pun? Someone, a reasonably stupid someone, even, would not mistake MikeRoweSoft for MicroSoft! An illiterate person, perhaps, and as much as we'd like to say that most of the trolls are so, if you're on the web, you have to be basically literate!
As a test, I showed my young son the two domain names and he noted that they sound the same but look different (as he's currently learning about homonyms, this was strangely relevant). I showed him the websites and asked him if he thought they were the same place. He gave me one of those "what the heck have you been smoking, mom?!" looks, and said, haughtily, "no! they have different names!"
So, there you go. Assuming most people on the web have a literacy and intelligence level of a precocious five year old, there is no confusion.
I'd also point out that the kid doesn't know what MicroSoft is and couldn't care less.

Well if Microsoft didn't have an army of lawyer they wouldn't be able to justify the price they charge for there unreliable software.

Yes the company I work for was put on cnn. We greatly hosted Mike Rowe and we support him 100%. I also do think that MS over reacted alot on trying to sue the kid. Oh and Suzanne send that to Microsoft and see what they say.

I do think it's daft. No reasonable person could possibly confuse the two.
If you want to run a parody of my business site, lol, I can't stop you. I can't imagine any of my clients confusing 0caddle with zerocattle, though. zerodogs? onecow? heh. I don't know. I just don't see where the infringement comes in. He does web design, they do software development, it isn't even in the same field (only by very broad definitions since they both use the web).

Kyle, if your name was Webbmunster Faurms, say, and you registered wbmstfrms.net, then we have a slightly different scenario.
I don't think that matters, because MS could argue that they develop web technologies which are used directly in that field, and, if Rowe doesn't develop software, what's the "soft" in his domain for?
